TERMS and CONDITIONS

1. Who we are

We are the Caledonian Brewing Company Limited, a company incorporated under the Companies Act (Company No. 104493). Our registered office is 42 Slateford Road, Edinburgh EH11 1PH. Please note that hereinafter when we mention “we”, “us”, “our”, etc., we mean the Caledonian Brewing Company Limited. When we refer to “you” we mean the user and/or browser of our website.

If you have any queries you can contact us on telephone (+44) (0)131 337 1286 (9 a.m. to 5 p.m.- Monday to Friday) or by email at info@caledonian-brewery.co.uk ; we aim to do our best to provide you, the user, with the answers and solutions that you require.

You, must be 18 years or over and resident in the United Kingdom to browse this site, if you do not comply with both criteria please leave this site immediately.

2. Purchases from the On-line Caledonian Shop

No-one under 18 years, or non-UK resident will be entitled to place an order or enter any competition on this site, (see separate competition rules). We shall not sell or deliver alcohol to anyone who is, or appears to be, under the age of 18, and therefore you consent to show proof of age on request before completion of delivery.

Payment for alcohol, goods and merchandise can only be made by credit or debit card.

The Caledonian Shop Opening Hours are: Monday to Friday - 9am to 5pm.

Any orders not received within these hours will not be deemed to be accepted and the sale will deem to be concluded upon the commencement of the next period of processing hours.

Please note that separate arrangements will be made for Bank Holidays and over the Christmas and New Year period. These arrangements will be notified on our Website.

3. Fulfillment of order

It may not be possible to fulfill all your order requirements and we reserve the right not to accept your offer, in which case we will have no further obligation to you. We may, however, accept part of your order, both in respect of the kinds of products ordered and the quantity of products ordered. The price will be reduced accordingly.

If the product(s) ordered is/are out of stock, you will be notified by email of the next available delivery time. If you would then like to cancel the order, you should reply to the email and your refund will be processed immediately.

4. Debiting your account

All payments are processed using Secure Trading any payments are authorised/rejected in real time. Payments are processed immediately and confirmation of your order sent to you by email within 24 hours of placing your order.

Security is of the utmost importance to us, which is why we use Secure Trading to process all online sales by way of a Secure Server.

They allow us to safely process your credit card payment with the Bank, and complete the financial transaction securely behind protected firewalls.

No personal or financial details are left unencrypted on a remote server, and such details are never sent by internet email.

The security symbol in the lower right hand area of the screen indicates the secure area of our website. Also, this part of the site begins with “https://www...” which indicates that this is on a Secure Server.

5. Acknowledgment

We will acknowledge your order by e-mail within 24 hours of receipt. You will, however, understand that notwithstanding this policy of notification we cannot guarantee that the notification we send will be received by you, nor that, if it is received by you, it is legible and uncorrupted.

6. Delivery and Distribution

We use distribution companies to deliver the products to you. We aim to deliver your order within 7 days but we cannot accept liability for any damage or delay to your order occasioned by an event beyond our reasonable control. If there is any reason why your order will not be delivered within 7 days, you will be notified by telephone or email, where reasonably practical.

There are standard delivery charges for central areas of the United Kingdom. We can, subject to an additional charge, deliver to further parts of the country such as the Highlands and Islands and we can also deliver to Northern Ireland and Eire. Prices on application. We are unable to deliver to other countries within Europe, the United States of America, Canada and the Far East.

7. Minimum order

We have a minimum order requirement of one case of beer or one item of merchandise. The case normally consists of twelve bottles or twenty-four cans, this is clearly marked in the product description.

8. Returns

We offer you a thirty day money back guarantee for damaged or faulty goods returned to us within thirty days of the date of purchase. We will reimburse delivery charges for damaged or faulty goods returned to us. When returning goods, please enclose: the receipt, details of the reason for the return and credit or debit card details (for purposes of refund). We are not obliged to accept returns of used or worn merchandise or beer that has in any way been tampered with.

9. VAT

All prices are inclusive of VAT.

10. Copyright

The images, graphics, selection and arrangement thereof, and all software compilations, underlying source code and all other material on the site are owned by us or are our property, or are owned by or the property of their content and technology provider.

While you may view website information in a web browser for private viewing purposes only, and permission is granted to copy electronically and to print on hard copy portions of this website for the purposes of placing an order with us, or using this website as a shopping resource, or for entering competitions or playing games or for general information purposes, any other use of materials on this website, including the production for purposes other than those noted above, modification, distribution or republication, without our prior written permission is strictly prohibited.

Occasionally we may publish images or text in which copyright is not owned by us. Where this is done, and where practicable, we acknowledge the copyright owner.

Nothing in these terms and conditions, or on our website, constitutes a licence to use or copy the website information.

11. Trade marks

Our trade marks and logos are registered in the UK and other countries and you may not use or reproduce any of the trade marks or logos mentioned on this website. Other products and company names mentioned on this website may be trade marks of their respective owners. Where practicable, we acknowledge the owners of all trade marks which are referred to in our website. You can access a list of our registered trade marks via the bottom of this page.

12. Data protection

We are registered under the Data Protection Act 1998. We undertake to maintain your privacy within the framework of the law.

You can decide what personal information you provide to us. We will only collect personal information that you choose to provide. Where possible, we will enable you to select how we will use this information (for example, by choosing to opt-in or opt-out of receiving special promotional offers).

You may choose to provide us with personal information if, for example, you: contact us with an enquiry; register on the site, fill out a survey or other form with your personal information included; request us to provide you with information; enter a competition; post information to public areas of the site or take advantage of a promotion.

You have the opportunity to choose not to opt-in to receive communications from us at any point where we request information about you.

We will not pass your information to selected 3rd parties without your consent. We will not send you information about other companies and their products and/or services unless you you have specifically requested such information.

13. Force Majeure

We do not take responsibility for any event which is outside our reasonable control nor for any consequential loss arising from such an event.

14. Entire Agreement

This agreement supersedes any prior agreements or arrangements which may have subsisted between us, provided the information you have given to us is not incorrect or fraudulent.

15. Severability

Notwithstanding that the whole or any part of any provision of these Terms and Conditions prove to be illegal or unenforceable the other provisions of these Terms and Conditions and the remainder of the provision in question shall remain in full force and effect.

16. Disclaimer

This site is provided “as is”, and if you suffer any loss, damage or expense as a result of visiting, or use of, our site, you will not have any claim against us or anyone who helped us to put together the site or contributed to it. We will have no legal liability to you in respect of any such loss, damage or expense. We don't give you any guarantee as to the quality of our site, its fitness for any particular purpose or the level of skill and care used by us in making it available to you. Any terms of this nature which may be implied automatically by law are excluded ( to the extent legally permitted). In general therefore providing the site “as is” means that :-

We make no representations nor give any warranties regarding the accuracy of our site. We work very hard to maintain that accuracy but we can't take responsibility for lack of it and you use our site at your own risk. 18. Governing law

Our registered office and principal place of business is situated in Scotland and the law of Scotland shall govern any interpretation in these terms and conditions. The Scottish courts shall have jurisdiction in any disputes between us.
